These Terms and Conditions ("Terms") govern your use of the PicMoment App. By using the App, you agree to these Terms.
1. Use of the App
- Users may upload one photo per day ("Daily Moment").
- You must be at least 13 years old to use PicMoment.
- You agree not to upload offensive, illegal, or copyrighted content without permission.
- The Company may provide additional services along with the services specified in these Terms when providing services to members.
- The Company may differentiate member tiers and segment usage limits, scope of services provided, etc., to apply different levels of service access.
2. User Content
- You retain ownership of your photos and captions.
- By uploading, you grant us a license to display your content within the App for social and functionality purposes.
- We may use anonymized data to improve AI recommendations.
Content Moderation and User Safety:
- 24-Hour Response Policy: All reports of inappropriate content or abusive behavior are reviewed and acted upon within 24 hours. Violating content is immediately removed, and offending users may face temporary or permanent suspension.
- User Blocking System: Users can block other users who engage in abusive behavior. Blocked users cannot view your content, send messages, or interact with your posts.
- Content Filtering: Our system detect and flag potentially inappropriate content before it's published. All flagged content is reviewed by our moderation team.
- Reporting Mechanism: Users can report inappropriate posts, comments, or abusive users through in-app reporting tools. All reports are confidential and reviewed promptly.
- Zero Tolerance Policy: We maintain a strict zero-tolerance policy for hate speech, violence, harassment, and other harmful content. Violations result in immediate content removal and account suspension.
3. Purchase and Usage of Paid Services
- Paid services purchased by members within the service may only be used within the service, and only when logged in with the same account that was logged in at the time of purchase.
- The usage period of paid content purchased by members follows the period specified at the time of purchase.
- Withdrawal of offer for paid services paid through in-app purchases must be requested directly from the store operator through which the member made the payment.
4. Advertisements
- The Company may display advertisements within the service in connection with the operation of the service.
- Members may be connected to advertisements or services provided by third parties through banners or links within the services provided by the Company. The Company does not guarantee their reliability or stability, nor does the Company assume any liability for damages.
5. Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, including:
- Immediate Action: Accounts posting clearly inappropriate content are suspended immediately upon detection.
- Progressive Discipline: First-time violations may result in temporary suspension, while repeated violations lead to permanent account termination.
- Appeal Process: Users can appeal suspension decisions by contacting our support team within 7 days.
- Data Retention: Suspended accounts' data is retained for 30 days to allow for appeals, then permanently deleted.
6. Limitation of Liability
We are not liable for:
- Content shared by users
- Service interruptions or data loss
